TRUSTEE'S SALE

 

Default having been made in the payment of the debts and obligations secured to be paid in a certain Deed of Trust executed on August 8, 2002 by Brian Aughinbaugh, a single person, to Jimmie Bearden, Trustee as same appears of record in the Office of the Register of Van Buren County, Tennessee in Book TD22, Page 622, the beneficiary being Ascend Federal Credit Union (formerly AEDC Federal Credit Union).  Subsequently STONE, HIGGS & DREXLER, P.C. was appointed successor trustee in Book RB 75, Page 251; and the owner of the debt secured having requested the undersigned to advertise and sell the property described in and conveyed by said Deed of Trust, all of said indebtedness having matured by default in the payment of a part thereof, at the option of the owner, this is to give notice that Stone, Higgs & Drexler, P.C. will on Monday, May 12, 2014 commencing at 12 oÕclock noon at the front door of the Van Buren County Courthouse, Spencer, Tennessee, and proceed to sell at public outcry to the highest and best bidder for cash, the following described property to wit:

 

Beginning on an iron stake in the North margin of J. T. Haston Road, (oiled) and also intersecting with the East margin of Bone Cave Road and running thence North 15¡ 59Õ West, 57.49 feet with the East margin of Bone Cave Road to an iron stake; thence North 23¡ 30ÕEast, crossing a pond with Arzie TempletonÕs line fence and on in all 635.21 feet to a fence corner; thence South 78¡ 25Õ East, 160.00 feet with the fence to a fence corner in Arzie TempletonÕs line; thence South 14¡ 30Õ West, 188.59 feet with Arzie TempletonÕs line to a walnut in the North margin of J. T. Haston Road; thence South 34¡ 20Õ West, 137.00 feet with the North margin of J. T. Haston Road to an iron stake; thence South 27¡ 59ÕWest, 153.77 feet with the North margin of J. T. Haston Road to a poplar; thence South 40¡ 30Õ West, 98.40 feet with the North margin of J. T. Haston Road to a post; thence South 53¡ 24Õ West, 166.60 feet with the North margin of J. T. Haston Road to the beginning, containing 2.28 acres.  Surveyed by Earl W. Smith, R.L.S. TN No. 466, P O Box 423, McMinnville, TN 37110, dated 6-26-95.

This sale is subject to 2012 and 2013 county taxes.

 

All right and equity of redemption, Statutory and otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed to be good, but Stone, Higgs & Drexler, P.C. will sell and convey only as successor trustee.

 

The sale date and time may be adjourned and rescheduled, without additional newspaper publication, within one year from the originally scheduled date, by announcement at the date, time and place of the new postponement date and time in accordance with T.C.A. 35-5-101.

 

This is an attempt to collect a debt and any information obtained will be used for that purpose.
