A man was sentenced for fraudulently spending $748 on a credit card, hitting a woman and violating an order of protection.
Charles Robert Fults Jr. appeared in Circuit Court for plea or trial selection. He was charged with fraudulent use of a debit/credit card, domestic assault, aggravated assault and violation of an order of protection. Fults was sentenced to 11 months 29 days on probation and ordered to pay court costs and $748 in restitution to the victim for fraudulent use of a credit or debit card.
He received this charge at the end of 2022. According to the warrant, on Dec. 29, 2022 Fults was at a residence and the victim found that her credit cards had been taken. There was reportedly a video of Fults using the credit card at an ATM. The victim made a report with an investigator. The investigator confirmed the fraudulent use of the credit card. The amount used was $748.
Fults received the domestic assault charge two days later. According to the warrant, the victim went to Fults’ residence to retrieve her 2013 Nissan Altima, cellphone and debit card Fults had reportedly taken without her permission. When she arrived at the residence, she got her car key from Fults. When she attempted to get in the car to leave, he reportedly became upset.
Fults allegedly became hostile when she asked for her phone and debit card back. According to the warrant, he got her phone out of the glove box and threw it at her, hitting her in the head, leaving a mark. When she asked about him taking her credit card and money, he reportedly hit her in the right eye leaving it bruised. The victim then started the vehicle and left. According to the warrant, this was not the first time Fults had been physically abusive with the victim. The warrant states she was in fear of her life and the safety of her children. He was also sentenced to 11 months 29 days on probation, ordered to have no contact with the victim and pay court costs for domestic assault.
In April of 2023, Fults received an aggravated assault charge and a violation of an order of protection charge. According to the warrant, McMinnville Police Department Officer Brianna Cooke responded to a residence with the Department of Children Services to do a welfare check.
While at the residence, Officer Cooke observed the victim’s left eye and left leg was bruised. The victim reportedly stated she was in a physical altercation the day prior with Fults. The victim stated Fults bruised her eye by hitting her with his head. The victim’s two juvenile daughters also confirmed this happened with DCS. The victim was a protected person in a final order of protection that expires on March 3, 2024 and had an active criminal bail order with Fults being the respondent in both.
Fults was sentenced to 11 months 29 days on probation to serve 364 days, ordered to pay $150 plus court costs and ordered to have no contact with the victim for violation of an order of probation.
The aggravated assault charge was dismissed. The fraud sentence is consecutive to the violation of an order of protection sentence and concurrent to the domestic assault sentence.
