A man has been bound on rape charges after a 16-year girl said he forced her to have sex even though his defense pointed out the girl never actually told him no.The defendant, Alenjandro Hernandez was bound to the grand jury by Judge Larry Ross following preliminary hearing in General Sessions Court.His binding on the felony, which carries eight to 12 years in prison, occurred after the girl told police Hernandez had unwanted sex with her after a relative, who was dating the man, left the residence leaving her alone with the man.“He came into my room and starting rubbing me,” the girl testified Tuesday. “He had sex with me”The girl said she never actually told the Hernandez “no” nor did she resist. She maintained she was afraid he would turn violent if she resisted although, on cross examination, she said she had never seen him be violent in the past.The judge bound Hernandez on the felony charge after hearing the testimony of the victim.
