TRUSTEE'S NOTICE OF SALE

 

  NOTICE is hereby given that on Thursday, June 26, 2014, at the hour of 11:00 o'clock, A.M., at the main entrance of the Van Buren County Courthouse in Spencer, Tennessee, the undersigned, as Trustee, under the following deeds of trust, encumbering properties which lie in the FOURTH CIVIL DISTRICT of Van Buren County, Tennessee, as follows:

 

(a)   Deed of Trust executed by Paulette Lewis, dated December 18, 2006, of record at Book RB37, page 238, RegisterÕs Office, Van  Buren County, Tennessee, encumbering the property described as Lot No. 48 below; and,

 

(b)   Deed of Trust executed by Dwayne Richards, dated February 13, 2008, of record at Book RB43, page 546, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 3 below;

 

(c)   Deed of Trust executed by Gillian James, dated November 30, 2006, of record at Book RB34, page 280, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 108 and 109, below; and,

 

(d)   Deed of Trust executed by Eleen Minto, dated February 28, 2008, of record at Book RB44, page 886, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 1 below;

 

(e)   Deed of Trust executed by Nadene Haughton, dated February 6, 2008, of record at Book RB49, page 884, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 72 below;

 

(f)   Deed of Trust executed by Terence A. Burnett, dated February 20, 2008, of record at Book RB43, page 561, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 106 below;

 

(g)   Deed of Trust executed by Lisa Holness, dated April 1, 2010, of record at Book RB56, page 928, RegisterÕs Office, Van Buren County, Tennessee, encumbering the property described as Lot No. 101 below;

 

  and by virtue of being appointed Trustee by the true and lawful holder and owner of said indebtednesses, according to that certain Assignment of Deeds of Trust dated April 26, 2013, and of record in Book RB70, page 965, RegisterÕs Office, Van Buren County, Tennessee, which Assignment is incorporated herein by reference thereto, and by reason of default in the payment of the obligations secured by said deeds of trust and the performance of the covenants therein contained, and at the express direction of the true and lawful holder and owner of said promissory notes secured by said deeds of trust, will sell, at public auction, to the highest bidder for cash, or credit upon the indebtednesses secured, at the option of the holder of the secured indebtednesses if the holder is the successful bidder, the interest conveyed to said Trustee by virtue of said deeds of trust, and the property therein described, which property lies in the Van Buren  County, Tennessee, and is more particularly described as follows:

  Being the same property acquired by Dwayne Richards, by virtue of a deed dated February 18, 2008, from Spencer Ridge Development, LLC, of record in Book RB43, page 544, Register's Office, Van Buren County, Tennessee.

   This conveyance and the real property described hereinabove are made subject to those certain restrictive covenants of record in Book RB28, page 670, RegisterÕs Office, Van Buren County, Tennessee; to the rights of others to and regarding prior mineral conveyances or reservations and appurtenant rights thereto; to the mineral reservations and all matters of record in the instrument of record at Deed Book 8, page 552, RegisterÕs Office, Van Buren County, Tennessee, to all matters appearing on the plat of record in plat book 1, page 191, et seq.; and to all easements of record.

 

   The street or mailing address of this property is Harper Road, Spencer, Tennessee 38585. This property is identified as Map 70, Parcel 201.00, in the records of the Assessor of Property for Van Buren County, Tennessee. 

 

   This sale will be made in bar of the equity and right of redemption without warranty as to title or encumbrances for the purpose of paying the debt obligation  secured by said deed of trust.  Said sale shall be subject to any restrictions, reservations,

 

conditions and liens of record applicable to said property, and is further subject to any County real property taxes against said property.

 

  In the event the high bidder at the foreclosure sale should fail to comply with the submitted bid, the Trustee shall have the option to accept the next highest bid in which the bidder is able to comply or to re-advertise and sell at a later date.

 

   Pursuant to Tennessee Code Annotated ¤35-5-104, as of the date of this Notice, there were no unreleased tax liens filed by the United States of America with respect to which the provisions of 26 U.S.C. ¤7425(b) require notice to be given to the United States

 

of America in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the United States of America or filed by the State of Tennessee with respect to which the provisions of Tennessee Code Annotated ¤67-1-1433(b)(1) require notice to be given to the State of Tennessee in order for the sale of the land thus advertised not to be subject to such lien or claim of lien of the State of Tennessee.

 

   The right is reserved to adjourn the day of the sale to another date certain without further publication upon announcement at the time said above.
