FORECLOSURE SALE

 

 WHEREAS, TOMMY SHAWN BRUCE, by Deed of Trust (the "Deed of Trust") dated October 8, 2010, of record in Record Book 58, Page 714, Register's Office for Van Buren County, Tennessee, conveyed to SAM SAWYER, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to HOMELAND COMMUNITY BANK;

 

 WHEREAS, said SAM SAWYER, Trustee, is unable to act as Trustee under the Deed of Trust, and I, RYAN J. MOORE have been appointed Successor Trustee by the owner and holder of the Note by an instrument of record in Record Book 75, Page 818, Register's Office for Van Buren County, Tennessee;

 

 WHEREAS, default has been made in the payment of the Note; and

 

 WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.

 

 NOW, THEREFORE, notice is hereby given that I, RYAN J. MOORE, Successor Trustee, pursuant to the power, duty and authority vested in and conferred upon me, by the Deed of Trust, will on July 11, 2014, at 10:00 a.m. at the front door of the Van Buren County Courthouse in Spencer, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Van Buren County, Tennessee, described as follows:

 

 Being all of Lot #178B of the Homesites of the Woodlands, Section 1, as appears on that certain plat of record in Plat Cabinet 1, Page 250, in the RegisterÕs Office of Van Buren County, Tennessee, to which reference is here made for a more complete description.

 

 Being the same property conveyed to Tommy Shawn Bruce by deed from TBKP Development, LLC, dated October 8, 2010, and filed for record on October 15, 2010 in Record Book 58, Page 711, RegisterÕs Office of Van Buren County, Tennessee, as corrected by deed of correction of record at Record Book 59, Page 337 in the Register of DeedÕs Office in Van Buren County, Tennessee. 

 

 The address of the above-described property is Lot #178B, the Homesites of the Woodlands, Section 1, Camp Creek Circle, Van Buren County, Tennessee.

 

Said sale shall be held subject to the following:

 

1.  Property taxes for 2013 in the amount of $1,379.00, 2012 in the amount of $1,259.00, and 2011 in the amount of $209.00 are due and payable.
