Sale at public auction will be on May 16, 2014 on or about 12:00PM local time, at the South side door, Warren County Courthouse, McMinnville, Tennessee, conducted by the Substitute Trustee as identified and set forth herein below, pursuant to Deed of Trust executed by RANDALL W SMITH, to Arnold M. Weiss, Trustee, on March 22, 2001, at Record Book 407, Page 870 as Instrument No. 24650 in the real property records of Warren County Register's Office, Tennessee.

 

Owner of Debt: WELLS FARGO BANK, N.A., SUCCESSOR BY MERGER TO WELLS FARGO BANK MINNESOTA, N.A., AS TRUSTEE F/K/A NORWEST BANK MINNESOTA, N.A., AS TRUSTEE FOR DELTA FUNDING HOME EQUITY LOAN TRUST 2001-1

 

The following real estate located in Warren County, Tennessee, will be sold to the highest call bidder subject to all unpaid taxes, prior liens and encumbrances of record:

 

SITUATE in the First Civil District of Warren County, Tennessee, being more particularly described as follows:

 

BEING in the Town of McMinnville and on Adams Street, beginning at a stake on edge of Adams Street at Northeast corner of Lot No. 6 in this subdivision and running westwardly with said Adams Street 80 feet to a stake at edge of street at McGee`s line; thence running Southwardly with McGee`s line 145 feet to a stake at McGee`s line; thence running Westwardly with McGee`s line 80 feet to a stake at McGee`s line; thence running northwardly with Walker`s line 145 feet to the point of BEGINNING.

 

Being Lots No. 6 and a part of Lot No. 5 in the Adams Subdivision, Block B, as shown in Plat Book No. 5, Page 178, Register`s Office for said County.

 

BEING THE SAME PROPERTY conveyed to Randall W. Smith, unmarried by quitclaim deed from Betty Joyce Smith being recorded simultaneously herewith in the aforesaid Register`s Office.

 

THIS CONVEYANCE IS SUBJECT TO any and all restrictions, easements, setback lines, conditions, plat of record, and encumbrances of record in the Register`s Office for the aforesaid County.

THE RIGHT IS RESERVED TO ADJOURN THE DAY OF THE SALE TO ANOTHER DAY, TIME AND PLACE CERTAIN WITHOUT FURTHER PUBLICATION, UPON ANNOUNCEMENT AT THE TIME AND PLACE FOR THE SALE SET FORTH ABOVE. All right of equity of redemption, statutory and otherwise, and homestead are expressly waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only as Substitute Trustee.

 

If the U.S. Department of Treasury/IRS, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor or Workforce Development are listed as Interested Parties in the advertisement, then the Notice of this foreclosure is being given to them and the Sale will be subject to the applicable governmental entitiesÕ right to redeem the property as required by 26 U.S.C. 7425 and T.C.A. ¤67-1-1433.

 

This property is being sold with the express reservation that the sale is subject to confirmation by the lender or trustee. This sale may be rescinded at any time. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid.  The Purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the MortgageeÕs attorney.
