A drunk driver with a child in the car who was arrested by officers on bicycle patrol during Back to The Strip was given 32 days in jail.
The woman, Brandi Bain, 27, entered guilty pleas before General Sessions Judge Bill Locke to charges of DUI and reckless endangerment, the latter charge coming when police found a 5-year-old child in the back seat of her car.
Additional charges of possession of legend drugs, as well as violation of the implied consent law for refusing to take a blood or breathe test were dropped as a result of her plea. She will serve 32 days of an 11-month, 29-day sentence, pay $1,100 plus costs, perform 24 hours public service work, attend DUI class and lose her driver license for one year.
She was arrested when police responded to a reckless driver call after someone reported seeing Bain swerve in and out of heavy traffic during Back to the Strip night last month. Officers pinpointed her location when another report revealed she had driven over a sidewalk at the Shell station on Smithville Highway.
When officers Jared Jacobs and Corey Floyd arrived, they found the Chrysler Sebring with two flat tires, apparently from where it had slammed into a curb.
The officers, who were patrolling the special event on bicycle, were able to weave their way through the bumper-to-bumper traffic to catch the woman. The lawmen found Bain had been fighting with people at the scene after one man had taken her keys away to prevent her from leaving before police arrived.
“She claimed she drove on the sidewalk because she was distracted,” Floyd said in his report. “When I asked what caused her to be distracted she was unable to say.”
Bain admitted she had taken medication at 9 a.m.
