Smith gets 364 days for sexual battery

A local resident has been ordered to serve a year in jail after entering guilty pleas Wednesday to two charges of sexual battery by an authority figure.

Charles Franklin Smith, 43, of the Jacksboro community was ordered to serve 364 days of a 10-year sentence by Circuit Court Judge Bart Stanley. In addition, Smith was ordered to be on the sexual offender registry for life.

Warren County Sheriff’s Department investigators were notified of the improper behavior by the female victim, who was 17 at the time. She is not related to Smith, but was reportedly in his care.

According to the arrest warrant, the victim “gave a statement that there had been sexual conduct between her and Charles.”

Smith was interviewed and he gave a statement that sexual contact had occurred between the two on two occasions in October 2020. The arrest warrant noted, “Charles Franklin Smith would have had supervisory and disciplinary power over Jane Doe.”

District Attorney General Lisa Zavogiannis said she is satisfied with the plea arrangement.

“One of the things we depend on is for our victims to cooperate and when a victim says that they don’t want to go to trial we try to get the best sentence possible,” said Zavogiannis. “The victim and her family were happy with this deal and that’s one of the things which is important to us as prosecutors.”
