Indictments were handed down by Warren County grand jury on Friday, including a man charged with vehicular homicide and leaving the scene of a fatal accident.

Gary Allen Driver was arrested in May and charged in the death of Mildred Herrin, who was struck and killed in a hit-and-run crash while working in her yard on Swan Mill Road. A preliminary hearing was held in October.

Evidence presented during that hearing by prosecutors suggests Driver was the person behind the wheel of a red pickup that was found with Herrin’s DNA on it.

Driver reportedly left the scene and hid the truck in a field in neighboring Grundy County.

Judge Bill Locke ruled there was enough probable cause to send the case against Driver to the grand jury. The grand jury’s indictment on Friday means Driver will face the changes against him.
