Duke sentenced for selling drugs in school zone

A local man charged for selling drugs from his home next to Eastside School in 2021 has been sentenced to 10 years. 

Devin Austin Duke, 28, was charged with manufacture, sale, or delivery of cocaine, marijuana, Xanax, and fentanyl in August of 2021. Those charges were enhanced because they reportedly took place in a school zone. He was also charged for being in possession of a firearm during commission of a dangerous felony. Sheriff at the time, Tommy Myers, said, “There were kids on the playground literally feet from his back door.”

Officers with the Warren County Sheriff’s Department and McMinnville Police Department issued a warrant for his arrest. According to the warrant, items found included 5.5 grams of cocaine, 123 Xanax pills, 3.7 ounces of marijuana, and 1 ounce of fentanyl. Two 9mm handguns were also found, according to the arrest warrant.

Duke was indicted on 11 different charges and pleaded guilty to five of them. He pleaded guilty to possession of s Schedule II controlled substance, cocaine with intent to deliver in a school zone, possession of a Schedule II controlled substance, fentanyl with intent to deliver in a school zone, possession of a Schedule IV controlled substance, Xanax with intent to deliver in a school zone, possession of a schedule VI controlled substance, Marijuana with intent to deliver in a school zone and possession of a firearm during the commission of a dangerous felony. 

In Circuit Court on Wednesday, July 26, Duke was sentenced to 10 years in Tenn. Department of Corrections to serve 364 days for possession of cocaine in a drug free zone, possession of fentanyl in a drug free zone, possession of Xanax in a drug free zone, possession of marijuana in a drug free zone and felony possession of a firearm. He was also ordered to pay $2,000 plus court costs.
