City considers options in wake of McMinnville Green's demise

There are disadvantages to being a landlord and McMinnville officials have begun to discuss some of them.

McMinnville Green, a recycling business that was leasing a portion of the city’s transfer station on Sunset Point Road, has gone belly-up. Owner John Hoch ceased operations Feb. 28.

The city’s Streets and Sanitation Committee met for an update on the lease agreement. 

McMinnville Public Works Department director Brad Hennessee said Hoch broke the lease agreement when he failed to pay monthly rent and has not complied with the city’s request for a written plan to vacate the premises. 

“I asked him for a letter stating that he was ceasing operations and a plan of action regarding the removal of the material that he has onsite. I did not receive that,” Hennessee said. “I went out to speak to him, and I did catch him out there one day. He told me that he started a new job and that was his focus. He wouldn’t discuss the issues about McMinnville Green and the transfer station.”

Per the lease agreement, the property is to be returned to the city in the same condition it was received. Hennessee expressed concern this will not be the case.

“The best answer that I got when we spoke verbally was that he is looking at a month and a half to remove the material that he plans to remove,” said Hennessee. “The part that was concerning about that was he pointed to some of the items that he can be working on over the next couple of weeks and up to the next six weeks. He didn’t point to all the material, so I’m not sure he has plans to remove all of it.”

There is damage to the building.

“I suggest we go out and look at the place,” said Hennessee. “There are some liability issues that we could possibly face in the way it was left. If there’s a time in the next couple of days that you would be available, we could do a walk thru and look at the material that’s onsite and the building itself. The damage to the building is probably going to be an eye-opener. I know it has been for me.”

City attorney Tim Pirtle was asked to review the lease agreement and provide officials with his determination on what they can legally do in this situation.
