 FORECLOSURE SALE NOTICE

 

  WHEREAS, by Deed of Trust (the "Deed of Trust") dated July 27, 2000, of record in TD Book 18, Page 108, in the Register's Office for Van Buren County, Tennessee, JAMES A. BALLEW and BERTHA A. BALLEW conveyed to Lynn Sparkman, (n/k/a Lynn Omohundro), Trustee, the hereinafter described real property to secure the payment of certain Promissory Note (the "Note") described in the Deed of Trust, which Note was payable to WHITE COUNTY LUMBER COMPANY, INC.

 

  WHEREAS, default has been made in the payment of the Note; and

 

  WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of the indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and the Deed of Trust. 

 

  NOW, THEREFORE, notice is hereby given that I, Lynn Omohundro, Trustee, pursuant to the power, duty and authority vested in and conferred upon me, by the Deed of Trust, will on June 26, 2014 at 1:30 p.m. at the North door of the Courthouse in Spencer, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located at 1003  Cummingsville Sparkman Rd., Doyle, Tennessee, Van Buren County, being Map 008, parcel 25.02 and described as follows:

 

  One trailor located on the below described property, Huntington Daynty Serial

 

# F20445142FK25326A.

 

  Beginning at a stake on the north right-of-way of the Cummingsville Bone Cave

 

Road;  thence North 250 feet to another stake; thence East 350 feet to another stake;       thence East 350 feet to another stake; thence West 350 feet to the beginning. 

 

  Containing two (2) acres more or less.

 

  Being the same property conveyed to  James A. Ballew, and Bertha A. Ballew by Warranty Deed from Howard B. Taylor, and wife, Harriet W. Taylor, which appears of record in Deed Book 27-V, Page 72 in the Register's Office for Van Buren County, Tennessee.

 

  The sale will also be made subject to the payment of all unpaid back taxes which are due and owing.  The proceeds derived from said sale will be applied to the payment of the costs and charges of the sale and the indebtedness set forth in the Deed of Trust.

 

The right is reserved to adjourn the day of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
