TRUSTEE'S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated January 22, 2005, and the Deed of Trust of even date securing the same, recorded April 15, 2005, at Book 125, Page 451 in Office of the Register of Deeds for Warren County, Tennessee, executed by Jennifer Rutledge and Greg Rutledge, conveying certain property therein described to Wesley D. Turner as Trustee for Ameriquest Mortgage Company; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee will, on May 2, 2014 on or about 3:00 P.M., at the Warren County Courthouse, McMinnville, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Warren County, Tennessee, and being more particularly described as follows:
Beginning at a iron pin in the East margin of Myers Cove Road being a corner of LF Smith; thence with Smith, South line North 28 degrees 42 minutes 04 seconds East a distance of 216.37 feet to a wood fence post; thence North 29 degrees 01 minutes 26 seconds East a distance of 560.96 feet to a iron pin; thence leaving Smith and severing the lands of Dorothy Francis (Book 250, Page 24) South 59 degrees 21 minutes 41 seconds East a distance of 291.05 feet; thence South 30 degrees 44 minutes 15 seconds West a distance of 417.24 feet; thence South 78 degrees 49 minutes 26 seconds West a distance of 199.19 to a iron pin; thence South 08 degrees 58 minutes 23 seconds West a distance of 148.05 feet to a iron pin; thence South 87 degrees 40 minutes 15 seconds West a distance of 182.52 feet to a iron pin; in the East margin of Myers Cove Road thence with the East margin of said road North 33 degrees 11 minutes 35 seconds West a distance of 22.60 feet to the point of beginning, containing 4.04 acres more or less as surveyed by Bobby J. Howard Registered Land Surveyor Number 2218 on 01-25-05 Project Number 05-009, phone number (931)761-4444.
