MEMPHIS, Tenn. (AP) — A man is set to stand trial again in the killing of a Memphis motel clerk.

The Commercial Appeal reports (http://bit.ly/1MT1M1T ) jury selection will begin Monday in the retrial of Michael Rimmer in the death of Ricci Ellsworth.

Forty-five-year-old Ellsworth disappeared in 1997 from a motel where she worked as a night clerk. Her body was never found.

In 2012, a judge found that Shelby County prosecutor Thomas Henderson, "purposefully misled" Rimmer's defense attorneys about evidence in the case.

Shelby County District Attorney General Amy Weirich recused her office from the case in 2014.

Rimmer was twice sentenced to death in Ellsworth's killing, once in 1998 and at a resentencing in 2004.

A judge says Rimmer will get a new trial because his defense counsel didn't properly investigate the case.
