A man caught smoking marijuana on his back porch was given a month in jail.
The man, Kenneth Darryl Roberts, 23, was ordered by Circuit Court Judge Bart Stanley to serve 30 days of an 11-month, 29-day sentence and pay $150 plus costs for possession of drug paraphernalia. He also had his probation violated on his prior conviction for delivery of drugs.
He was ordered held in jail until he can get a bed at the Tony Rice Center where he is to undergo rehab. He is to stay as an in-house patient at Tony Rice for four months before being released to a half-way house where he is to stay for six months.
Roberts’ probation was violated and his new charges brought when lawmen came to his residence to serve a warrant. It was during the visit, sheriff’s investigator Steven Carpenter caught Roberts smoking marijuana.
“He was sitting outside on the deck smoking what he stated was marijuana,” Carpenter said. “A search of his room revealed a cigarette pack containing a small amount of marijuana.”
The officer said he also found a syringe and a spoon believed used for ingesting drugs.
