Muncey denies claim he aimed compound bow at pedestrian

A man has been charged with aggravated assault after allegedly pointing a loaded compound bow at another person, but he claims there is no victim in the situation. 

Paul Wayne Muncey, 48, appeared in General Sessions Court for arraignment Tuesday morning via Zoom. He is charged with aggravated assault and possession of drug paraphernalia. Muncey was arrested on Dec. 3. 

According to the warrant, Sgt. Jay Hutchings responded to the area of Rebel Hill Street and North Spring Street for a report of a male pointing a loaded compound bow at another male. When Hutchings arrived, he observed Muncey with a compound bow walking. Muncey was then detained. Lt. Paul Springer spoke to the complainant who reportedly stated he was walking his dogs on Rebel Hill Street when Muncey pointed the loaded bow directly at him placing him in fear. Hutchings also located a glass pipe on Muncey resulting in the paraphernalia charge. His bond was set at $11,000. 

During his arraignment, General Sessions Judge Ryan J. Moore asked if Muncey would like an attorney to represent him. Muncey asked if he would be able to take care of the charges today. He also asked if the paraphernalia charge could be dropped and asked to go to rehab. 

“Well Mr. Muncey, there is an alleged victim involved, so at an arraignment ...” started Moore.

“Who was the victim?” interjected Muncey. “I was just walking down the sidewalk. There was nobody around me.” 

Moore said he did not know the specific details of the situation, but would be happy to enter a plea of not guilty and have an attorney represent him if he wanted. 

“There wasn’t a victim involved. I wasn’t around anyone,” said Muncey. 

“Sir, the alleged victim wants to pursue it. You are innocent until proven guilty. Would you like me to appoint an attorney to represent you?” asked Moore. 

Muncey again stated he wanted to take care of it today. Moore informed him this is a felony charge and he could have his case bound over to the grand jury if he wanted. 

“No, I need to get a lawyer. I did no assault, sir,” said Muncey. 

Muncey entered a plea of not guilty and had a public defender appointed. He is scheduled to appear back in court on Jan. 16 at 1 p.m. Muncey also requested a bond reduction and Moore said if the Public Defender’s office wants to file a motion for a bond reduction they can, but did not reduce it that day.
