A man will serve a month in jail for assaulting his pregnant girlfriend and then trying to claim she had cut him during their fight.The man, James C. Evans Jr., 30, was directed by General Sessions Judge Bill Locke to serve 30 days of an 11-month, 29-day sentence, undergo the batterer intervention program, and must make restitution to Arms Apartments for domestic assault and vandalism.His sentence comes after his five-month pregnant girlfriend told police a verbal disagreement had turned physical, with Evans pushing her down and choking her.“He grabbed her around the neck and torso, squeezing her so hard she felt she could not breathe,” said McMinnville police officer Rachel Nichols, noting she saw signs of choking injuries as she was investigating the case.The victim said she was pushed down on the bed and became trapped between the headboard and mattress. She said she acted like she was passed out in order to stop the assault. She said Evans then went about destroying the apartment and trying to set her up for cutting him.“He took a pocket knife out of his pocket and cut his arm and then carried it to the bed and touched the point to the victim’s palm,” said Nichols, noting Evans tried to accuse the victim of the knife assault during questioning.The victim had to be freed from her entrapment in the bed by a neighbor who came to her aid.
