Driver says he had eight, nine or 10

The old adage of an accused drunk driver claiming to have had “a couple of beers” was way out the door with one accused DUI suspect who admitted he had “eight, nine or 10” before he was pulled over.The accused drunk driver, Jimmy D. Gunter, 46, of Spencer will face hearing before General Sessions Judge Larry Ross this week on charges of second-offense DUI, reckless endangerment and driving on a revoked license.His charges were brought after sheriff’s deputy Jason Richardson pulled him over on Sparta Street.“I was driving into work when I saw a Toyota pickup driving on the wrong side of the road in front of Wendy’s,” Richardson recalled in making the traffic stop.The deputy said his suspicions were immediately heightened when he saw what was in the truck.“In the vehicle were about two dozen containers of alcoholic beverages including Natural Light, Natural Ice and Evans Williams whiskey,” Richardson said.In addition to the circumstantial evidence, Richardson said he noticed Gunter had slurred speech and was unsteady on his feet so he asked him how much he had to drink.“He refused the sobriety test but did admit to drinking eight, nine or 10 beers,” Richardson said of Gunter’s statement to him.Richardson said he charged Gunter with second-offense DUI when he found out about his past conviction for DUI in 2008.
